Tax Impact Simulator — Donating a Work of Art

A comparative estimate of the federal and Quebec tax benefit under three programs for donating art to an accredited organization in Canada. For a detailed description of each program, see our article Disposing of a Work of Art: Donate or Sell?
Estimate for guidance only. This tool applies simplified federal and Quebec tax parameters (2025 tax year). It does not constitute tax advice. Each situation must be validated by a tax professional and by the relevant organizations (notably CCPERB certification for cultural property).

1Your Situation

Quebec — the MVP covers Quebec only; other provinces will follow.

Cost of Acquiring the Work

Used as the basis for calculating the potential capital gain (ACB). Includes only costs that are capitalizable for tax purposes — i.e., directly tied to acquiring the property, not ongoing costs of ownership.

Amount paid at the time of acquisition.

$

Transportation, framing and installation costs, authentication appraisal, acquisition commission, restoration carried out before taking possession. Excludes insurance, routine maintenance, and storage costs incurred after acquisition.

$

Total acquisition cost (ACB): $10,000

Grey area to confirm: the line between capitalizable costs and ongoing expenses is not always clear-cut. A major restoration carried out after acquisition, for example, may be capitalizable if it durably increases the value of the work rather than simply maintaining it — a determination that depends on the facts and should be settled with a tax professional before being added to the ACB.
Program 3 only — the certified cultural property gift would be made to a designated Quebec institution Required condition for the 25% increase to the FMV for purposes of the Quebec credit on certified cultural property gifts. Does not affect Program 2, which gets its own 25% increase simply by virtue of being a gift to a Quebec museum institution.

Comparison of the Three Programs

Total acquisition cost (ACB) — purchase price + capitalizable costs$10,000
Fair market value (FMV) of the gift$50,000
Potential gross capital gain (FMV − ACB)$40,000
Effective marginal rate applied to the gain (actual progressive calculation)38.3%

Gift to an accredited organization

A registered charity that does not acquire the work as part of its primary mission.

benefit
Federal credit (net of Quebec abatement)$12,084
Quebec credit$11,992
Capital gains tax (actual progressive calculation, 50% inclusion)−$7,660
Estimated net benefit$16,416
Special conditions — Within the 75% federal net-income limit ($71,250) — credit fully claimable this year. An official receipt is required. No net-income limit in Quebec (abolished since 2016) — only the 75% federal limit applies.
Please note: In Quebec, in the case of registered charities, you may claim the fair market value (FMV) of your donation for tax purposes only after the donation has been sold. At that time, the FMV will be determined as the lower of the following amounts: the proceeds from the sale of the artwork or the FMV of the artwork at the time of sale.
⚠ AMT risk flagged — the capital gain and/or the credit claimed are large enough to potentially trigger the Alternative Minimum Tax. Not calculated in this tool (2024+ rules: 100% inclusion of the gain, donation credit limited to 50% for AMT purposes); to be confirmed with a tax professional.

Gift to an accredited museum or museum-type organization

A recognized Quebec museum institution, without certification as exceptional cultural property.

Federal credit (net of Quebec abatement)$12,084
Quebec credit$14,992
Capital gains tax (actual progressive calculation, 50% inclusion)−$7,660
Estimated net benefit$19,416
Special conditions — Within the 75% federal net-income limit ($71,250) — credit fully claimable this year. FMV increased by 25% for purposes of the Quebec credit only (a mechanism specific to gifts to a Quebec museum institution, distinct from CCPERB certification). The federal government does not recognize this increase. Remains subject to the usual capital gains tax (no exemption, unlike Program 3). No net-income limit in Quebec since 2016.

Certified cultural property gift (CCPERB)

An exceptional gift certified by the Canadian Cultural Property Export Review Board.

Best

benefit
Federal credit (net of Quebec abatement)$12,084
Quebec credit$14,992
Capital gains tax avoided+$7,660
Estimated net benefit$34,736
Special conditions — No net-income limit (federal or Quebec) — credit fully claimable in the year of the gift, no carry-forward required. Full exemption from capital gains tax. FMV increased by 25% for purposes of the Quebec credit (designated Quebec institution). CCPERB certification is required, and for a Quebec institution, additional certification from the Conseil du patrimoine culturel du Québec is also required. The process takes longer.
Parameters applied (2025, to be indexed annually):
  • Federal — 15% on the first $200 of the gift; 29% on the excess; 33% on the portion of the excess corresponding to taxable income above $253,414. Annual limit: 75% of net income for Programs 1 and 2 (the excess may be carried forward up to 5 years); no limit for Program 3 (certified cultural property).
  • Quebec — 20% on the first $200; 24% on the excess; 25.75% on the portion of the excess corresponding to taxable income above $129,590. No net income limit since 2016, for all three programs.
  • 25% increase to the FMV for purposes of the Quebec credit only — applies to Program 2 (gift to a Quebec museum institution, automatic) and Program 3 (certified cultural property gift, if the designated institution is located in Quebec). These are two distinct mechanisms; the federal government does not recognize either increase.
  • Quebec abatement — the net value of the federal credit for a Quebec resident is reduced by 16.5% (federal tax abatement).
  • Capital gain — 50% inclusion rate on the gain (FMV − ACB), taxed using an actual progressive calculation that accounts for crossing the 2025 federal and Quebec brackets (not a flat rate). Programs 1 and 2: the gain is fully taxable. Program 3 (certified cultural property): full exemption.
  • Alternative Minimum Tax (AMT) — not calculated. A qualitative risk flag appears for Programs 1 and 2 when the capital gain or the credit claimed is substantial, but no amount is estimated.
Out of scope for this tool: corporations and estates (distinct tax treatment), multi-year gift-spreading strategies, confirmation of actual eligibility for CCPERB certification, confirmation of the donee's "Quebec museum institution" status for Program 2, and provinces other than Quebec. These parameters and thresholds must be confirmed with the CRA and Revenu Québec before any production use.
